MEMBERSHIP POLICIES & MEMBERSHIP RULES

1. Introduction

1.2 Scope. This Privacy Policy applies only to information we collect from you offline (e.g., when you sign up at one of our facilities or clubs) and does not apply to information we collect at or through our Internet web site. 2. Information We Collect

    We collect information from you when you purchase a membership and other services from us. The information we collect includes the following:
    • Name
    • Home address
    • Home telephone number
    • Work telephone number
    • Email address
    • Gender
    • Date of birth
    • For corporate sponsored program participants only: Name of Employer
    • For health insurance related program participants only: Insurance Information
    • For school-related programs: name of School or Group

• For children enrolled in our youth program: we collect from the parent/legal guardian, the name, date of birth, parent/legal guardian contact information, list of known allergies, and physical description (hair and eye color)

We also collect a limited amount of fitness, physical activity and health related information from you if you sign-up for personal training services or our Fitness Orientation service. This information (such as whether you suffer from a heart condition, dizziness, high blood pressure, and knee or back problems) helps you determine your eligibility to participate in our personal training and Fitness Orientation programs. If you participate in our training or orientation programs, we may also obtain certain measurements, height, weight and age from you. We keep this information confidential, and only disclose it to our employees who have a need to know this information.

Guests are asked to complete a Guest Fitness Profile that requests your contact information and certain demographic information. We do not share this information with third parties, and use this information to track guests that use our facilities. We may also use this information to provide marketing or promotional materials to you regarding Finish Fit®, LLC services and products.

Cardless Check-in System. Finish Fit®, LLC has implemented a Cardless Check-In system in many of its locations. This allows members to check-in with a trainer without their card. Finish Fit®, LLC has partnered with Front Desk, Inc., a leader in the CRM industry, to develop this convenient new way to check in to our LOCATIONs. We do not sell, lease, rent, trade or otherwise transfer the data to any third parties.

3. How We Use Your Information

    3.1 To Provide Products, Services and Information. We use your personal information to:
    • Set-up your membership
    • Provide services and products to you
    • Process payments for your membership, including credit card, debit card and bank account debit (ACH) transactions
    • Contact you regarding your membership and for service-related announcements
    • Provide you with advertisements, newsletters, promotional and other information relating to products and services that we provide or otherwise offer    for sale

4. How We Share Your Information

4.1 Providing Products, Services and Information. We may share your information with our third party service providers and agents in order to provide you with the products and services you purchase from us, as well as newsletters and other information which we believe may be of interest to you. For example, we use third party service providers to process credit card, debit card and bank account debit (ACH) transactions and payments, and to send out direct mail, email and other communications to our members. Contracts with our third party service providers require them to keep your personal information confidential.

4.2 Legal Requests or Requirements and to Prevent Harm. We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on Finish Fit®, LLC. We may also share information when we have a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to prevent harm to Finish Fit®, LLC, our members or other individuals. This may include sharing information with other companies, lawyers, courts or other government entities.

4.3 Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business to a third party, we may transfer your personal information to the new owner to be used consistent with this Policy. In such a case, your information would remain subject to the promises made in the applicable Privacy Policy.

4.4 Corporate and Insurance Programs. If you have a corporate employer sponsored or health insurance sponsored membership, upon the request of your employer or insurance provider, as applicable, we may share usage statistics and information, including your name, date of birth, insurance identification number and how often you use one of our facilities.

You can opt-out, update or change your information by contacting us as described above. You can also opt-out of receiving marketing and promotional emails from us by using the opt-out or unsubscribe feature contained in the emails.

6. Security of Your Information

We use industry standard physical, technical and administrative security measures to protect your information. Our employees have access to your personal information only on a need to know basis. Contracts with our third party service providers require them to keep your personal information confidential.

7. Changes to Our Privacy Policy

If we decide to change our Privacy Policy, we will post those changes on the finishfit.com web site. We reserve the right to modify this Privacy Policy at any time, so please review it frequently.
